BYVOICE (hereinafter referred as we, us, our, BYVOICE) with its registered office at: ul. Zamknięta, nr 10, lok. 1.5, 30-554 Krakow, Poland, value the privacy and data confidentiality of all Users of our services. That’s why we’ve developed this End-Users Policy (hereinafter referred as Policy). The Policy is to explain to our End-Users how we collect and otherwise process their personal data we receive from our Customers.
The scope of this Policy is limited only to the BYVOICE End-Users. Other matters including processing of personal data of BYVOICE Customers are governed by our general Privacy Policy. You can read it by clicking this link https://www.byvoice.io/privacy-policy/.
We pay your attention that during personal data processing of End-Users, we act as a data processor. It means that we don’t use the collected personal data of End-Users for our own purposes and act strictly within the scope of instructions provided by the BYVOICE Customer who is the data controller.
BYVOICE built an AI-first platform that helps businesses automate communication with clients across digital channels using voice and chat-agents. It’s designed to streamline support, boost sales, and eliminate routine, without compromising quality or control.
For the purposes of the Policy:
1) “Personal Data” means any data or information that enables the identification of an individual (whether directly or indirectly), such as their family name, first name, photograph, postal address, email address, telephone number, social media account data, data relating to their transactions, order details and subscriptions, IP address, cookies, voice, as well as any other information about them. Under this term, we also cover all personally identifiable information (PII) or personal information, as may be defined by certain regulations.
2) A “BYVOICE End-User” (hereinafter referred as End-User) means a person who uses BYVOICE via Customer’s services. We process personal data of End- Users in accordance with this Policy.
3) A “BYVOICE Customer” (hereinafter referred as Customer) means a person or legal entity that purchases our services.
Please note that the Customer is the data controller for the processing of End-User personal data. The Customer determines the scope of personal data related to End-Users that we will collect for the purpose of providing the services.
As we act as a data processor, the categories of personal data collected about End-Users depend on the specific Customer and its activity, needs and the selected set of functionality. In the table below, we’ve tried to summarize the main categories of End-Users personal data that can be processed by us.
BYVOICE will retain End-User Personal Data in accordance with a Customer’s instructions (including performing any applicable terms in the Customer Agreement and through Customer’s use of services functionality) and as required by applicable law.
Operation of BYVOICE’s infrastructure to process inbound and outbound calls, chats, emails, and SMS, ensuring high-quality performance.
Maintaining stable service performance through visualization, monitoring, and error detection tools
Providing usage statistics and dashboard reports to the Customer.
Providing Users with a properly working Services
All data processed on behalf of the Customer will be deleted after contract termination or upon Customer instruction, in compliance with applicable laws on personal data requirements for data minimization and retention periods. Data processed by BYVOICE as a Data Controller is subject to BYVOICE’s Privacy Policy retention periods.
As a rule, we don’t provide End-Users personal data to third parties unless it’s required to fulfill the instructions of the Customer or obligations under applicable law. The transfer of End-Users data is only possible in the following cases:
1) to our affiliates
We may share End-Users personal data with affiliates or subsidiaries and keep some of End-Users personal data in business records for the accounting and compliance purposes. In the event of a merger, acquisition, reorganization, bankruptcy or other similar event BYVOICE reserves the right to transfer End-Users’ personal data to our successor or assignee.
2) to our sub-processors
We always try to do our best to ensure the greatest user experience. That’s why sometimes we need to collaborate with partners who assist us in various aspects of our services, thereby enhancing their quality. We carefully select the companies which implement adequate legal, organizational, and technical measures to protect personal data from unauthorized access. But BYVOICE can’t finally guarantee absolute compliance with data protection laws in all cases.
We transfer End-Users personal data:
Customers select the LLM, Speech to Text, and Text to Speech providers. Data is transferred to and processed by the selected providers, which determine the location and means of such processing.
3) to third parties as required by law
BYVOICE may share personal data in cases where we are required to do so by law, by court order, or in other situations where we have reasonable grounds to believe that the transfer of your personal data is necessary to initiate legal proceedings in the event of a violation of the Terms or any applicable laws. In addition, if we have reasonable grounds to believe that it is necessary to prevent fraud or other activities that are contrary to applicable law, End-Users personal data may be transferred to authorized bodies.

Since BYVOICE acts as a data processor on behalf of the data controller, we process personal data solely based on the controller’s documented instructions. You may exercise your data protection rights directly with the controller. BYVOICE assists the controller in fulfilling its legal obligations, including informing about data breaches, and, upon completion of the processing, will return or securely delete personal data as instructed.
